Roundtable discussion regarding the List of court decisions to be included in the Unified Registry of Court Decisions
02.20.2012On February 14, 2012, the Council of Judges (COJ) and State Judicial Administration (SJA) with support from the USAID FAIR Justice Project (FAIR) conducted a roundtable discussion on the approach to be taken by COJ and SJA regarding the List of court decisions to be posted online in the Unified Registry of Court Decisions. The need for such discussion arises from the latest amendments to the Law on Access to Court Decisions authorizing the Council of Judges of Ukraine to elaborate upon agreement with the State Judicial Administration the above mentioned list of court decisions.
Chair of the COJ Yaroslav Romaniuk, Head of the SJA Ruslan Kyryliuk, FAIR Justice Project Chief of Party David Vaughn and Deputy Chief of Party Natalia Petrova as well as representatives of the COJ, councils of judges of specialized courts, SJA, legal professionals’ associations and mass media participated in the roundtable.
The discussion revealed differences in opinions regarding composition of the above mentioned list. In particular the participants discussed the proposals of SJA, Supreme Court of Ukraine, High Specialized Court of Ukraine, High Economic Court of Ukraine, High Administrative Court of Ukraine and Council of Judges of administrative courts. In the course of the meeting the FAIR Justice Project organized video conference with FAIR expert Markus Zimmer who provided the participants with possible improvements of the Unified Registry of Courts Decisions. Natalia Petrova emphasized that deficiencies of the current Law on Access to Court Decisions cause obstacles with public access to court decisions. In this connection she invited the participants to develope amendments to the Law which would increase transparency and accessibility of Ukrainian judiciary. Mr Romaniuk mentioned that the COJ would consider the list at its upcoming meeting to be held on February 17, 2012. He also expressed the willingness to continue cooperation with FAIR Justice Project to improve Unified Registry of Court Decisions.
